With some renewed focus on innovation in India, more and more companies are setting up some level of Research, R&D support, or application development center in this rapid growing market. While some of these organizations are there to support the local growth and others are there on more regional or global missions, all of us need to be aware of the IPR picture in this emerging market. This report provides an overview of the existing IP systems of governance in India, some changes and trends, and important links to many of the agencies involved locally.

As with many business practices and processes in India, the IP picture is clear when viewed from a distance, and a bit more cloudy when confronted at close proximity.  Without a doubt, there are clear procedures in place to handle every situation, but understand which office to contact for a given situation can be a challenge.  This report provides both the context and the specifics information needed to get through these challenges on the ground in India.   The slide on the right shows a very high level overview of the government’s IP organizational structure.  It’s useful to note that India’s IP administration has grown with the demand placed on it to support the growing industry and  research capabilities in India.   As early as the 1950’s, companies like Unilever were setting up product development and R&D capability in India, but it wasn’t until the 1990’s that the real need for clear IP protection proceedures and administration took on enough priority to get some dedicated attention.   Infrastructure demands continue to outpace supply, and IP is no exception.   Having said that, there is an abundance of government support with respect to IP, and if one know’s where to turn, answers are avalable.  On the bottom of this short summary is a list of links that may also be useful.   This full report highlights some of the history and outlines the current state of IP administration in India.  You won’t find a better single report covering this topic anywhere else. …Read more
